My Customer Filed for Bankruptcy…Now What?
Given the current economic climate, with substantial interest rate increases, stubbornly high inflation, and continuing supply chain challenges, experts believe that after several historically slow years, business bankruptcy filings will begin a rapid rise in 2024. While experts are often wrong, it nevertheless makes sense to have a game plan in place in the event they are proven correct. During this interactive presentation, Thomas Fawkes and Brian Jackiw of Tucker Ellis LLP will walk through key strategies that creditors should consider – and implement – if their customer files for bankruptcy to maximize recoveries and in furtherance of a continued business relationship. Among other things, procedures for filing unsecured and administrative expense claims, seeking critical vendor treatment, addressing issues with long-term contracts and leases, participation on unsecured creditors’ committees, and evaluating chapter 11 plans and disclosure statements will be discussed.

Advanced Bankruptcy
Having a basic understanding of the bankruptcy laws and the procedure generally followed by companies seeking bankruptcy protection puts credit professionals at a distinct advantage compared to their peers when it comes to navigating a customer bankruptcy successfully. During this presentation, Thomas Fawkes and Brian Jackiw of Tucker Ellis LLP will provide a broad overview of the United States Bankruptcy Code and the Federal Rules of Bankruptcy Procedure – including the key provisions impacting trade creditors – and will further provide an overview of the “typical” business chapter 11 bankruptcy. In addition, we will discuss recent changes to the Bankruptcy Code, including the institution.
